defective item

got item at beginning of October 2016 and no it is not working.  What rights do I have?

Much depends on the delivery dates you got when you bought.  You have the right to file a claim for Significantly Not As Described on eBay for up to 30 days AFTER that LAST estimated date of delivery.  It may be too late for this but one way to find out:  Go to the RESOLUTION CENTER at the bottom of the page and try to open a SNAD claim. 

 

If it is too late, you  can still file a SNAD case with PayPal.  You have 180 days from when you PAID to file with PP.  Go to the resolution center under TOOLS. 

 

The reason to try eBay first is with eBay on a SNAD case the seller is supposed to pay return shipping.  With PP, the buyer pays rtn shppng.  If it is some cheap copy of something from China, it will not be worth it. 

 

Both these places tell you to FIRST contact the seller, so do that.  Sometimes just to keep you happy and if it is cheap they will just refund you in full so that you leave positive feedback.  Then you don't have to file at all.  Othertimes they try to trick and delay you. 

 

If the seller promises a replacement item, politely say No Thanks and that you would prefer a refund.  The replacement never arrives, its just to delay you further.  You'll know if you're being treated fairly or not.
