i cant get my refund back , seller wont reply

 my order was placed sept 9th 2014. I have still have not received it.

i have emailed the seller.

seller replied nov 7th 2014 stating they had to recall the order and then it was being sent out nov 8th 2014.

its now december 19th 2014 and I have emailed a couple times since.

Now I have been trying to contact ebay and can't. About getting my refund as its about 45$ canadian.

You only had 45 days to open a Dispute with eBay.

They are firm about that.

BTW, if in future a seller offers to replace an item you have not received, refuse.

This is a fairly new scam, mostly out of Asia, and there is a pretty good chance the first item was never sent and the second won't be either.

Since more than 45 days have passed, go to the credit card you really paid with (Paypal is just a mediator) phone the 1-800 number and ask about a chargeback.

But do this immediately. Credit cards have deadlines too.
