Are you the buyer or the seller?
Is this an Item Not Received Dispute?
My first guess would be that eBay has decided that the seller is fibbing, has never sent the first item and will not send the second.
Is the seller Not A Registered User (NARU)?
That means eBay has closed him down.
However, you can go to Paypal and reopen your case there.
DO NOT AGREE TO A 'REPLACEMENT'. It won't arrive, and while PP does allow 180 days for Disputes, these scammers are very good at putting off the buyer until all deadlines pass.
The PP Resolution Centre is at the top of your PP account page under Tools.
You have, I presume, already been in touch with the seller, so you can skip the Contact Seller suggestion, and go directly to the Claim.
DO NOT AGREE TO A 'REPLACEMENT'.
If the seller cannot prove delivery (not shipping, delivery) you will be refunded.
Then, if you still trust the scammer seller, you can start a new transaction and reset the clock.
If the purchase (or less likely the replacement) arrives later, you can return the refund by using PPs Send Money service.
