is it ethical to sell a replica rolex watch on e-bay?

hi, I would like to know if it is within e-bay rules to sell a nice imitation rolex watch. I would be very clear in the description, not to mislead anybody. I have seen other replica rolex's for sale on e-bay, clearly stating that it is a fake! I want to do the right thing here. I don't need to make enemies early in my e-bay career. many thanks....todd

The official policy on eBay is very clear:

"We don't allow replicas, counterfeit items, or unauthorized copies to be listed on eBay. Unauthorized copies may include things that are bootlegged, illegally duplicated, or pirated. These kinds of things may infringe on someone's copyright or trademark."

It may be true that same sellers break the rules.  That is their problem.  Do not make it yours.

The correct term is not 'replica' or 'imitation' , it is counterfeit.

Counterfeiting is illegal.

It would be a replica if it looked similar to a Rolex but didn't have the word Rolex or logo on it. That could be sold but the word Rolex could not be mentioned. If the watch has Rolex on it but it isn't one..it is counterfeit and it is illegal to sell on ebay and anywhere else.

Even if another seller lists a similar item, it doesn't make it 'ok' for someone else to list the same thing. Often sellers who get caught will lose some or all of their sellers privileges.
