As we all know, the Tariff war has begun. Here is the latest- but it may very well change during Trump's State of the Union Address tonight (He has threatened that any country- namely Canada, Mexico, and China that imposes retaliatory tariffs as a counter-action will see additional tariffs applied. Of course, Canadian Prime Minister Trudeau announced the Canadian tariffs this morning). Section 321, 19 USC 1321, also known as statute that describes de minimis, is a section that allows for smaller valued items to go through customs duty-free. Under President Biden, the amount was increased from $200 to $800- where it sits today. Most goods we sell should be processed without issues or additional costs to the receiver (buyer) or exporter (seller). Again, this may change at any time because of the threats made by the US about us having the nerve to stand up for ourselves. I would not be surprised if he reduces the amount back to $200 tonight or blocks the loophole altogether.
What's important is we stay united as Canadian sellers- look at diversifying our markets. Together we will get through this!! 🇨🇦 🇨🇦

As you may know, tariffs on goods imported to the US from Canada went into effect today. These regulations are evolving, and we are keeping a close eye on updates from official government sources.
As the US regulations stand today - March 4, 2025 - the de minimis exemption remains. This means that the vast majority of Etsy orders can currently enter the United States duty-free because they fall below the $800 value threshold.

Can anyone remember how long it took for eBay to fix the auto update on Co0 when it was incorrectly defaulting to Canada/Province after being inputted correctly when you printed? Wasn't it months???

Well no, maybe you think you know but you or your sources are simply wrong.
The increase in the de minimis exemption from $200 to $800 was part of the Trade Facilitation and Trade Enforcement Act of 2015, signed in February of 2015. Joe Biden was NOT President in 2015 or 2016.
The TFTE Act was passed by an overwhelming bipartisan majority in both the House 256 - 158 and 75 - 20 in the Senate.

OP1 year agoFirst off- The term 'as we all know' refers to the tariffs being implemented- nothing to do with Section 321. If you want to get technical- I'll gladly debate the issue with you. As I admitted, I made an error of when it was increased. But the point I was making is that it may be decreased- the loophole closed today by Dump.

·1 year agoI'm waiting to see what comes from that as well, but I don't think he can do much about the de minimis right now. The USA doesn't have the manpower to process the additional mail items. It would cause the mail system to collapse. That's the reason why he backed off in February. Once they have their new tax collecting department set up, then he'll drop or significantly lower the de minimis.

There has been gossip that the Project 2025 would be in favour of that, and that was one reason deJoy with his strong ties and investments in courier companies was made Postmaster General. (He recently resigned.)

OP1 year agoYes- Dejoy has ties with couriers- I wrote an article about those ties when he was appointed in 2020. Gotta be honest, I didn't think he would last as long as he has in the position. All they can do is spot checks- but some will get caught- and another excuse for another tariff.

OP1 year agoValid point- and he keeps laying off people... smart move- lay off most of the IRS (for example) just before tax season. The same goes with CBP- Although no official numbers yet, but friends at CBP and Homeland Security have been warned of possible layoffs.

·1 year agoDe minimis was raised to 800 in 2016 under Obama. Biden had actually signed an executive order to remove about 1/2 of all goods imported from de minimis exemption in September 2024. It never was implemented but is currently working it's way though Congress as legislation.
