Updates to the eBay User Agreement and Privacy Policy were posted on www.ebay.ca on February 4, 2013. Updates to the eBay International Selling Agreement were posted on www.ebay.ca on February 20, 2013. The updated User Agreement, Privacy Policy and International Selling Agreement are effective immediately for new members and on March 26, 2013 for current members.
eBay User Agreement
Key updates to the eBay User Agreement:
- Provisions regarding user name, password and accuracy of information. You are responsible for all use and misuse of your user ID and password and for keeping your registration and payment information up to date.
- Updates to the Use of eBay section. You agree that while using eBay, you will refrain from engaging in those actions identified under the “Using eBay” section of the User Agreement.
- Provisions regarding using eBay to trade across borders and related tools and services such as language translation, currency conversion estimators, and international shipping calculation tools, which may be available to eBay members. While eBay may display sellers’ listings on one or more of eBay’s international sites, sellers may still choose to restrict international buyers from purchasing their items. If sellers choose to make their items available internationally, they will be subject to eBay’s International Selling Agreement and the policies governing the sites where their items are purchased.
- Updates to the Fees and Services section to promote the prompt payment of eBay fees. Not paying fees or taxes owed in a timely manner will subject you to late fees, collection activities, restrictions in your ability to use eBay’s sites, services, or tools, and/or the possible reporting of information regarding your account to credit bureaus, which could be reflected in your credit report.
- Provisions regarding our authority to contact you via telephone. We included provisions regarding our authority to contact you at telephone numbers you have provided to us or that we have obtained pursuant to our Privacy Policy, using auto-dialed, pre-recorded messages or text messages. This authority is limited to purposes authorized by you in our Privacy Policy and controlled by your communications preferences in the “My eBay” section of the site.
- Updates to the Disclaimer of Warranties and Limitations of Liability section. We updated provisions limiting eBay’s responsibility and liability for specified activities, circumstances, and occurrences and establishing the boundaries of eBay’s liability, if it is found liable to you or others.
- Updates to the Release section. You agree to waive any protections that would otherwise limit the coverage of the release given by you to include only those claims which you may know or suspect to exist in your favour at the time of agreeing to the release.
- Provisions regarding listing and purchase conditions. These sections contain certain provisions you agree to when listing or purchasing an item. Also, these sections have been updated to specifically recognize eBay’s right to end listings.
- Provisions regarding use of eBay’s mobile applications. To cover the growing popularity and use of eBay’s mobile applications and to provide for possible new ways we may display the terms and conditions applicable to them in the future, we added references to these applications throughout.
- Updated provisions regarding venue and personal jurisdiction. Any claim or dispute between you and eBay that arises in whole or in part from eBay services must be resolved exclusively by a court of competent jurisdiction located in Toronto, Ontario and you agree to submit and attorn to the original and exclusive jurisdiction of those courts in respect of any such dispute or matter.
eBay Privacy Policy
Key updates to the eBay Privacy Policy:
- Updates regarding our Global Privacy Standards. Updated language regarding eBay Inc.’s global privacy standards and our new eBay Privacy Center. These updates include links to our eBay privacy center, and additional language regarding the applicability of our global privacy standards.
- Provisions regarding Mobile Privacy. Updated language regarding mobile use and access our sites, applications, services, and tools. Specifically, this updated language notifies users that the Privacy Policy applies to their access or use of our sites, applications, service, and tools via any mobile device.
- Updates regarding your access to your information and rights to opt-out of marketing and promotional communications. Updated language regarding your ability to access your information and to control your communication preferences, including marketing and promotional communications. This updated language informs users of their rights regarding our use of their information for marketing purposes, as well as their rights to control their communication preferences, and notifies users of the consequences of withdrawing their consent for our use of their personal information to provide access to and use of our sites, applications, services and tools.
- Updates relating to the description of our collection and use of Personal Information. Updated language to reflect additional details of our collection and use and disclosure of personal information. Specifically, updated language notifying mobile users of what information we collect from them when they access our sites, applications, services, and tools from a Mobile device. We also updated the descriptions of the information we collect to better reflect the individual categories of information, as well as updated the corresponding use cases for the Personal Information we collect.
- Updates regarding how we protect and retain your Personal Information. Updated language regarding the measures we take to protect your Personal Information and about our retention and deletion of your Personal Information. These updates included specific language informing users our commitment to protect the personal information we collect and use, their rights to close their accounts if so desired, our commitments to retain personal information in order to comply with all applicable laws, prevent fraud, or enforce our policies.
eBay International Selling Agreement
- By accepting the User Agreement, you also accept the International Selling Agreement. The terms of the International Selling Agreement apply when you list items for sale on an eBay site with an eBay Buyer Protection Policy or with an international shipping option.
As with previous updates, other changes have been made to keep the eBay User Agreement, Privacy Policy and International Selling Agreement up-to-date with our product and service offerings. For your convenience, we have reproduced in bold font here, the paragraphs in the User Agreement, Privacy Policy and International Selling Agreement that have changed since we last posted such documents on our site. Paragraphs in regular, non-bold font have not changed since the last version of the User Agreement, Privacy Policy and International Selling Agreement that we posted.
You do not need to take any further action to accept the updated eBay User Agreement, Privacy Policy and International Selling Agreement. If you choose not to accept the new terms, you should stop using eBay and the eBay.ca and cafr.ebay.ca sites, as applicable, and terminate the User Agreement, Privacy Policy and International Selling Agreement by closing your eBay account. Visit this help page for further direction as to how you can close your account. If you do not close your account within thirty (30) days of March 26, 2013, the effective date of the updated eBay User Agreement, Privacy Policy and International Selling Agreement for all current users, then we will assume that you have read and understand the amendments to the User Agreement, Privacy Policy and International Selling Agreement and accept the terms and conditions of the amended User Agreement, Privacy Policy and International Selling Agreement. You will be deemed to have accepted the amendments, with no additional written agreement or express acknowledgement required, and waived all statutory requirements for notice and express acceptance of the amendments except as provided in this Notice. We encourage you to review the updated User Agreement, Privacy Policy and International Selling Agreement to familiarize yourself with the updates.
