The following is from the eBay duplicate listing policy:
The following types of listings, if they are for the identical item, will be considered duplicate listings even though the listing format or details may vary:
Auction-style listings for identical items even if they have different ending times, start prices, or reserve prices.
An auction-style listing with the Buy It Now option and an auction-style listing without the Buy It Now option for the identical item.
A fixed price listing and an auction-style listing with the Buy It Now option for the identical item.
With respect to the third bullet, how about a fixed price listing and an auction-style listing without the Buy It Now option? Is that considered a duplicate listing?

you can have an auction without BIN and a separate fp for the identical item
you can have duplicate aucitons withotu BIN now, ebay will just hide them from search results until they have a bid

Based strictly on the wording of the policy restrictions, you would think that would not be considered a duplicate listing, but I'd hesitate to try it.
I've wondered about this myself, but as I say, I haven't had the courage to test it -- I prefer to leave well enough alone with respect to my current seller status. I'd be interested to see if any other seller has attempted this and not had the listings pulled or otherwise been slapped on the wrist.

Like you, rose-dee, I don't want to be hit with a policy violation, so I wondered if someone knew for sure.
