I send him his invoice for $14 S & H plus $40 for insurance, which he states he did not want to pay. So I swallow the insurance cost as well, just in case it went missing.
He received the comic today and states he is not happy and wants a refund telling me I didn't fully describe the comic. Now I've refused, firstly on priciple, and secondly it was clearly from his emails after that he regreted his impulsive and uneducation purchase. Who spends that kind of money when they still have unanswered question?
Right, so theres no way I'm refunding because the item is exactly as described. Cost that he should have covered (ie insurance) I had to pay. So my question is, what happens now? He opens a dispute, what happens to my account? Can I still sell or will they freeze everything until this one is sorted?

I would stick to my guns for now, but if he does file with PayPal you might want to think about working something out on how it gets returned to cover your own butt.

I take it a 5.0 grading is not very good (at least has some major defects)? Not sure why you didn't include more specific details to describe the major defect (married pages) in the listing rather than after the fact.

This sounds like you told the buyer "thanks for buying oh by the way here's the defect I didn't mention in my listing".
This is an experienced buyer, perhaps they should have known what a 5.0 grading means but it's somewhat irrelevant. Since they paid via PayPal they will have no problem sending it back to you and getting a full refund. As Monique implies, if you don't stay on good terms with the buyer you could have a serious loss. On the positive side if they get a refund through PayPal you will get your fees back and if you move quickly you can still get your eBay FVF's refunded (time is running out quickly for that).

Recped...a 5.0 for a Cap America 1 even restored is rare to say the least. The highest graded is only 8.0...this is a comic that was published in 1941. The 8.0 would presently sell for upward of $200,000.
So if I refund, even if he covers the cost of shipping back to me I'll be out at least $300...???
Will he win a claim with paypal when he got exactly what he bid on?

Pray that we insures the item properly cause if it get damaged then you will be out even more $$$.
You best option is to calculate the amount of your loses and offer a refund less the out-of-pocket expenses you incurred.
Hopefully he will accept and you can repost and most likely resell the item to a buyer that accepts it the way it is.

Yep, as long as he returns it with tracking.
i don't understand this??? if he bid on exactly what was described, why should he win? when i was speaking to a paypal rep a while back, they didn't give any indication that the buyer wins unless there really IS a discrepancy in the listing??? they'll have to actually go in and look for the discrepancy that the buyer is claiming...its not automatic???

OK so all I know about comic grading I learned in a few minutes on Google.....
recped, you sure I haven't bought comics off you...LOL
Paul, the only criticism I might have is that the CGC serial # should may have been mentioned so the experienced buyer would know where to go to get the graders notes on the book.
Also Paul, How did you ship to get this collectible fully insured? I think I would consider finding a way to get it back the same way, fully insured. Your out of pocket loss should not be to great as you can get your ebay and paypal fees back and get a possible listing fee credit if you relist and it sells. You may then recoup your loss on the resell.
This is not an issue I would leave in the hands of Paypal.
