Does eBay Money Back guarantee cover defective items?

There is something wrong with an expensive item I bought. The seller does not accept returns (as stated on the listing, haven't contacted them yet). So I want to open a case but which reason should I choose : Doesn't work or defective or Doesn't match description or photos ?

Here is what it says on eBay Money Back Guarantee page:

 

Not covered

  • Buyer's remorse or any reason other than not receiving an item or receiving an item that isn't as described in the listing (see the seller's return policy for return options).

 

I'm afraid that if I choose "Defective" it will not be covered by the ebay Guarantee...

You can still open up a Money Back Guarantee case even if the seller does not offer returns.

Yes, if the item is not as described, it can be placed under "defective."

However.

The Money Back Guarantee will tell you that the seller is required to send you a Return Shipping Label so you can return the defective item at the seller's expense, not your own.

Unless your seller is also in Canada, this is impossible.

And if the seller is overseas, returning for a refund with Confirmation of Delivery will cost you $40. The seller may be told to refund this, but there is no way to enforce it.

While eBay may settle the case in your favour, and refund without requiring a return, don't count on it.

 

Even the most willing non-Canadian seller cannot send you a Return Shipping Label.

EBay does not understand this.

Yes, indeed, I've experienced this as a seller. I'm willing to accept the cost of returning the item (and the customs fees which seem to be non-refundable with GSP). I'm just not sure if the seller will accept the return so I want to make sure I'm protected by the eBay Guarantee.

This seller has been a member since 2002, but only recently started selling.  He has left 3 feedback as a seller, all for expensive items.  He has received 1 feedback on those sales, and his sold and completed listings show only the earrings you purchased, not the other recent sales. 

 

The photos in the listing are not quite in focus, but I can see that the post is bent, and the ball at the end of it doesn't seem to be fitting quite correctly.  The question that was asked about the size of these earrings was not well answered by the seller.  For that kind of money, you would think the seller would have worked a little harder at the listing.

 

The seller may not be aware that no returns does not mean no refunds.

 

I am not quite sure how returns for Item Not as Described work within the GSP.  Other Canadian posters to these boards will have more advice for you about that.  But eBay does have GSP specialists on staff.  I would be inclined to contact eBay by phone and ask for one of them.

 

Did you receive an invoice with your earrings?  In order to claim a refund on duty and taxes, you need to file a B2G form with supporting documents including specific information about your purchase, the original duty and sales tax paid and evidence that the goods have been returned.  The GSP lumps together taxes and duties (if applicable) along with their fees for customs brokerage under "Import Charges".  I don't know how or if you are able to get the documentation you will need to claim back whatever portion of the $247.38USD was duty and/or taxes.

 

Are you otherwise happy with the earrings?  Can they be repaired?  Would you want to try to work with the seller to get a partial refund -  after talking to a reputable jeweller and getting an estimate for repairs (and perhaps a valuation)?
