If the seller offers to replace the item, ask for a refund instead.
You have no reason to believe the item will be better packed the next time around. And the time used by making a replacement will take you past the 45 day Claim deadline from eBay/Paypal.
You may have to return the item on your own dime to get a refund. The cost of the return is not usually refunded. Some sellers will accept pictures of the damaged item, especially pictures that include the damaged parcel.
