I won 2 actions from the same seller, both auctions clearly stated free shipping to me

I won 2 actions from the same seller, both auctions clearly stated free shipping to me, now a day later the seller is stating the listing didn't say free shipping and is demanding I pay an extra 35 dollars.

I sent the seller 2 screen shots of the listing, and I didn't get a response. he then refunded my payment and now won't respond to my contact.

 

I've attached the files so you can see what the seller was sent.

Does he not have to honor our agreement? or can he/she simply walk away?

Seller can walk in the sense that no one can force him to ship but as stamps said receiving negative feedback and low DSRs carries serious consequences.

 

I would deny any request to cancel and should he take the unpaid route , enter your PP payment receipt to the dispute and ebay will close.

 

Simply put , seller made a mistake . Domestic shows a shipping amount. Would not charge US and offer free international. That said , placing the burden on the buyer as take it or leave it shows considerable inexperience. It is the sellers mistake and either own it and ship or reach a compromise or a cancellation with buyer or prepare for the likely response.

 

I would not repay.

Here is the relevant section of the Selling Practices Policy..

 

Examples of prohibited behaviour include:

Entering an amount for shipping costs when you're listing an item, and then indicating that you charge a different amount either in the item description or after the buyer has committed to buying the item.

No he can't simply walk away.

He either has to offer you a Mutual Cancellation or open an Unpaid Item Dispute.

With the MC, you can accept, ignore or refuse. If you refuse, he has no tools left. You can leave appropriate feedback, and Detailed Seller Ratings. The lowest Rating is ONE star. If a seller's ratings drop below 4.3, his ability to list and sell will be restricted for up to a year.

With the UID, your defense is to pay the original invoice. Which you have already done. If he refunds the payment again, you can still leave feedback and DSRs, and he has a violation against his seller account.

Neither of these will force him to ship, unless he decides that selling on eBay is less important to him than the $35 he stands to lose on shipping.

I don't think I'm going to pay the seller again, unless he/she agrees to send my items, all that will happen if my items are not sent, is tie up my money, and force me to file an unnecessary claim with paypal, I don't understand why eBay won't step in on cases like this.

 

And before you ask, yes I've tried to contact them, but I just get stuck in looped pages of gobbly goop.

 

I may call them about this next week.
