Late and incomplete order

Hi

I purchased and paid for 3 items as BIN with a single paypal payment from one seller in Germany on July 24th.  I did write him on Aug 17th, told him it had not arrived and asked for tracking but I did not receive a reply.  This was a large volume seller with feedback of 99.3%  

 

The package arrived today, August 31 and the stamp is dated Aug 16th.  There are only 2 items; the most expensive is missing.  At this point it is already more than 20 days past the last due date of Aug 9th and looks like it was not even mailed until 15 days ago.  I can try to contact the seller and at this point I think the best option is to ask for a refund for the missing item.  If he does not respond to my request for a refund do I file an item not received INR or a SNAD because I received 2 of 3 items?  How does ebay know the order is incomplete since it came in one package?  There was never any tracking given to me and no signature at the time of pickup.  If I file INR, doesn't the fact that I got a package dispute that?  I don't want to be asked to return the 2 less expensive but perfectly fine items all the way to Germany.

Sounds complicated,but im sure someone will have an answer for you soon on here,or if you dont hear from another poster contact ebay and ask them,im guessing its an item not as described case,being that the order is incomplete,hope that helps a bit,just wait a day er two someone will give you advice

 At this point it is already more than 20 days past the last due date of Aug 9th

 

You have 30 days after that 'last due date' to file a Dispute.

 

I think the best option is to ask for a refund for the missing item.  

Probably.

Attach a picture of what you did receive and of the postage. (Because international postage is based on weight, if the postage is too low, it is evidence that the parcel held less than it should.)

 

But be aware that sellers are suspicious of claims for partial refunds, especially when it is the 'most expensive' that is missing.

Sigh.

 

And time is short if 'more than twenty' days have already passed.

The Significantly Not As Described. Because you will be saying that you did receive the package, just not all the goods that were supposed to be in the package.

Kinda like buying a pair of earrings and only getting one.

 

 I don't want to be asked to return the 2 less expensive but perfectly fine items all the way to Germany.  

So we use our charming Canadian politeness to get our own way.

Hmm. While your eBay Message should explain the problem clearly in English, it may help to add a Google Translate/Babelfish translation of your Message.

These short shipments are always tricky.  Best wishes.

 

 

PS. The slow shipment makes me think the seller might be dropshipping from another country. Did yours come from the city and country of the seller? His address appears on your Paypal invoice.

In reply to femmefan, Thank you for your advice.  The item came from the seller's personal address so I don't think it was drop shipped.

 

 The box is small and the 2 items (new toys in their original packaging) plus 3 small "air balloons" as packing, filled the box so there was no room for the larger item.  It didn't fall out along the way, I think he simply didn't put it in.  

 

I don't understand the late shipping but life happens.  Shipping was "free" on each of the 3 separate auctions but I assumed he would ship all 3 together to save his shipping costs.  

 

Perhaps he was short on stock and mailed it separately and that is what I asked in the message I sent this evening.  He relisted this european toy (not available in north america) so I am guessing he has a steady supply.  

 

I realize that partial refunds are a suspicious request but he should be able to tell from his inventory that he never sent it.  He has 20,000+ selling transactions so hopefully he is organized.  

 

This was an ebay.com listing.  His customers mostly leave feedback in english and so does he but it is all identical so I cannot tell what his grasp of English actually is.  He didn't respond to my message on August 17th which does concern me.
