Hello,
I am new to eBay, and bought my first item, an "unlocked" Samsung Galaxy Rugby cell phone on Saturday. I sent the seller a polite email asking for a shipping tracking # from the post office. He never replied, which raised a bit of suspicion.
Yesterday, I received the phone at the post office. I went to purchase an activation card, and found out it was a locked cell phone, and I would need to pay $65.00 (quoted price) to unlock it. I notified the seller, and asked him to reimburse me for it.
Two hours later, the battery died. At that point I made a claim with paypal, in the dispute resolution centre. This morning, I went to a Rogers Wireless branch, and they informed me that that the seller had probably deliberately tampered with the litmus paper for the cell phone battery. It was completely removed, and the battery was damaged, and possibly fried.
I escalated the claim, since it has been almost 6 days, and the seller has not replied or communicated with me. I am stuck with a junk cell phone. It's strange, since I have used kijiji dozens of times, and never had anything remotely close to this happen, as all of my dealings with people have been positive.
Did I jump the gun on filing a claim, or did I do the proper procedure for handling this type of incident? Any feedback would be greatly appreciated.

No you did the right thing. The seller may be stalling. You have only 45 days to open a claim. Escalate it now, which will give you another 20 days for resolution.
More likely Paypal will tell you to return the phone with Delivery Confirmation. When the DC shows the item delivered, PP will refund you (if the seller has not) and go after him for the money.
You cannot keep both the item and the money. PP will not reimburse the return cost.
You will be able to leave feedback and Detailed Seller Ratings.
DC shipping includes Regular Parcel (domestic), Expedited, and ExpressPost. The new Tracked Parcel is also Delivery Confirmed.
If the total you paid for the phone was over $250, you will also be asked to provide Signature Confirmation.
