ripped me off did not send refund after I did not receive item went past 45 days what can I do?

Go to the credit card you really paid from . (Paypal is just the mediator between you and the seller. The actual payment came from the card you filed with PP)
Phone the 1-800 number on the card and ask the customer service rep. about a chargeback. Have your transaction details (dates, payment amounts, transaction numbers) handy to help her process the refund.

That is true only if the OP indicated that they wanted to pay with a credit card

If the bidder didn't pay from a credit card, he's out of luck.
Every Paypal account should be backed by a credit card and every purchase should be made from that card. To do anything else is foolish.

I don't agree. It makes more sense for me to pay for an item from the U.S with my U.S.$ Paypal balance rather than use my credit card and then have to convert those same U.S. $ into Cdn $ to pay my credit card bill. To use my credit card 'just in case' I have a problem that Paypal doesn't cover or just in case I don't bother to file with Paypal until it is too late would be more foolish imo.
