how do i get ebay to step in

hello. i bought two items from a seller i later realised was a scammer.it was $42 dollars cad and I'm trying to get eBay to step in but i don't know how. could someone please help me out here?

Did you not receive the items or are you baying that they are not as described?  What have you done so far, have you opened a case to request?

You have only 30 days after delivery or last estimated delivery date to start a Dispute.

From the dates they were sold (June 26 & July 5) I am thinking not yet arrived.  If they were mailed separate they probably came slow mail with no tracking.  There is now way they COULD have arrived by now if that's the case.  Free shipping means they could take 2 months to arrive.  I could be wrong and maybe its something else.  No info in the FB, no info here.  If they have a long delivery estimate it might not be possible to open a claim yet since they are still in the mail.
