how to appeal a decision from ebay

We purchased an item from ebay . The item arrived and was not working. Asked seller for return. He accepted the return but could not provide a shipping label.  The sale was from  in China. We called ebay and followed the reps advice. Asked the seller how he would like the item returned. He advised the cheapest method of returning it. We chose a more expensive way so that the parcel was sent Air mail from Canada.  We offered to pay the difference in price for the faster postage. We sent several messages after the arrival date came and past.  I asked Ebay to step in because the seller was giving us the run around. Blaming it on the postman, over and over again.  They sided with the seller. Something about returning the parcel without sellers or ebays methods? Now it seems that we are out of the original purchase money and the extra postage that we paid. They have said that we can appeal. I cannot find the option under the drop down menu under actions........ Very frustrating. I have sent Ebay several messages saying the we would like to appeal the decision.  Looking at he feed back of the seller there are quite a few similar cases.  Why does ebay continue to let these people sell on their site?

You are going to have to phone ebay with your notes. By sending your item back WITHOUT TRACKING the seller will claim it has not been received as a Return and now you are out of pocket completely. You will need to prove to ebay that you've been given very bad advice by the seller and incorrect advice by your first Customer Service rep. No Tracking means no Refund. The best you can hope for is a courtesy refund by ebay.
