Unauthorized Use of My eBay Account

Two weeks ago a hacker got into my eBay account and spent $4,600 on my linked credit card.

I have reported this to the credit card company and to eBay.  Both parties assured me that they would investigate and I will assuredly get my money back.  However, both parties told me that the other one was responsible for making the reimbursement to me.

Can anyone tell me how this works and what I should expect as it has now been two weeks since the incident.

If the hacker accessed eBay to gain control of your account and CC information, I'd say that it's eBay's responsibility, and therefore, the one who has to make you whole again.

 

But I'm not a lawyer, so...

Without knowing exact details (were the purchases actually made through your eBay account/show in your purchases here?) Or are you guessing it's from eBay because it's the credit card you have attached here? Do you use it anywhere else online? What about while you're out and about. I've had my card comprimised in the past at a gas pump (someone copying cards that were swiped there).

I would think it should be the credit card company. If I had unauthorized items I would contact the credit card compant first and say these are not my charges and immediately cancel the card. If you know for certain it was through eBay they definitely need to be aware and investigate, but I think it would be the credit card company. (But like John I'm not a lawyer).

Remember to file Item Not Received claims for all the fraudulent purchases.

You may have to prove that they were shipped to a fake address.

 

And file a police report. Put the number into your eBay and cc claims.

Thanks for your responses.  Just to clarify:-  The items show up in "My Purchases" just as if I had made them myself.  The seller has told me that the imposter asked for a personal pick up and he handed over the items even though the "purchaser" was not in possession of a valid eBay pick up code number!!  The items are in my purchase list as still awaiting delivery - to me!!

Should I follow the "Item Not Received" procedure and request a refund?

So you are the Buyer (of record).

The fake buyer has the product.

The real seller has no proof of delivery?
(That would be the QR/pickup code).

 

Why are you being charged?

Of course you will cooperate with the scammed seller, but I'm not clear what financial harm was done to you.

I must lack a criminal mind.

Again, this is (to me) proof that the hacker was able to login into your eBay account and use the payment info stored in there to do the fraudulent purchases. eBay dropped the ball, so they need to assume responsibility

 

You need to contact de Canadian Centre for Cyber Security asap, and report the incident:

Thanks for the advice.  I reported this to Cyber Security. 

I assume eBay is currently holding my "payment" until the transaction is complete and then they will pay the seller, which will never happen because the transaction is not complete until I get the items.  Therefore I assume that eBay will eventually reimburse me.

I opened an "Item Not Received" case and in 5 days eBay should step in to resolve it with the "Money Back Guarrantee"

Don't assume anything.

Continue to monitor the transaction, including filing a Claim for non-receipt and that police report, which should be attached to the Claim.

 

The seller has learned a hard lesson here.

And that's a pretty big "if", in my opinion.

 

eBay sends me emails and messages when I log into my account from a device that it doesn't recognize, and I suspect that should be the case for all users.

Just to close this off:-

Since the items were in my "Purchases" list as not having been delivered I opened an "Item Not Delivered" case.  After waiting the requisite 3 days I asked for eBay to step in.  I immediately received an email informing me that a refund has been issued.  I am now a happy camper.
