is it mandatory for a seller to provide a tracking number? I payed for an item over a month ago and seller claims to have sent it. Did not provide tracking number and claims not to have one...

You do not say what the item is nor where you bought it, but if it was sent cheap-o mail it would not have tracking. Tracked items to Canada are usually expensive, - the postage that is. If it has truly been a month your item ought to have arrived by now.
There is not much more to be gained from contacting the seller who will continue to insist the item is on its way. Maybe it is, maybe it isn't. You have a very low feedback and ebay is rife with sellers who will take advantage of that, not send the item and then delay you past the 45 day deadline.
So if you want to wait one more week just to see if it finally shows up, fine, but counting from the time you paid you should file your dispute no later than day 43. Do not let it pass by, and do not close the dispute until you have either your money back or your item. A closed dispute can never be reopened.
