Am I Required to Give a Refund In This Scenario?

Some backstory. I had up for auction a videogame which bidding ended on December 20th. The winning bid was for somebody in New York (I'm in Canada). I offer two shipping options at checkout for US customers: a cheaper untracked lettermail option and a slightly more expensive tracked parcel option. In the item description, I have this:

 

"BUYERS FROM THE U.S.: Two shipping options are available. The cheaper option does not include a tracking number, so no refunds will be processed if this option is chosen and it gets lost in the mail. Thank you for your understanding."

 

The item was shipped out on December 23rd (so right before Christmas). eBay gave the estimated delivery as being January 8th. They messaged me the following day to say they hadn't got it. In a polite way, I told them to be patient and wait a bit longer (there's been some bad weather, not to mention it was shipped out during the holidays).

 

Today they opened up a refund request and I have no idea what to do. I can just barely afford my tuition costs for this term and now I have to worry about a refund too. Does anyone know if my stipulation would hold up or would eBay ignore it and grant the buyer a refund?

 

While it doesn't have tracking, I do have photographic proof that the item was shipped out, as well as confirmation from Canada Post that the shipping/customs declaration form for the package was created and paid for.

 

Any help would be really appreciated.

We got one going to a suspected scammer and will find out what happens with with the UR number after it is delivered. We will post back here with the outcome. We put whiteout over  the words "no delivery scan" and "balayage non requis".

GOOD NEWS EVERYONE!

I left the tracking courier as Canada Post. I got an email from eBay early this morning to say the item had been delivered. All of the tracking scans were there (there was 6 of them) and it shows it reached the buyer the afternoon of December 28th.......

That’s great!
The buyer opened a refund request right?  Did you enter the tracking number in that request as well?  Some sellers say that you should..others say that it’s not necessary but it can’t hurt to enter it.

Yes, I originally had no tracking info uploaded when it shipped out. I put the tracking info within the refund request. eBay uploaded the tracking scans and sent me a message saying it had been delivered.

 

The request will close in 17 more hours if the buyer does not respond

ANOTHER UPDATE:

 

Buyer responded to the tracking info I uploaded with "The tracking you entered shows up as invalid"

As others have stated it will not show on the mail carrier's sites. As long as it shows delivered on ebay you are all good. The buyer is checking the number on the mail carrier tracking site.

Yep. I can see all of the tracking updates along with the final delivered update at 12:33pm on Dec 28

Ebay considers it valid - you shouldn't have to do anything else.
