So I sold this statue to a woman in the US, and it cleared customs in what I assume is FedEx's customs clearance center in Memphis, Tennessee. From there it went to Pennsylvania, where it seemed to be delayed by about a week by the Fedex location in the Buyer's city. They told me it was apparently waiting on some customs papers which seems backwards since why would it even leave the clearance center in Memphis if it were not cleared??
Anyhow, the buyer today sends me some bad photos of a open box and claims the box did not contain the statue! She speculates that customs took the statue out of the box to inspect it and did not put it back into the box. Is this even possible?? Wouldn't there be some sort of weight check done after the item clears customs? Wouldn't someone in customs notice and ask,"What is the ugly statue from?"
I have a BAD feeling that eBay is going to side with the Buyer. Even if their claim is legit, am I as the seller even responsible for what customs does with my package, especially after clearing customs? I have the default insurance of $100, but I assume that is just another potential landmine of issues.
I've sold over 100 items on ebay with 100% feedback rating, and this is such a gut punch.

It may not be your 'fault' if the item didn't reach the buyer but it is your responsibility that the buyer receive the item they purchased. There is no way to prove if the box was empty and eBay is not going to investigate so if you do not refund the buyer, eBay will likely refund them from your funds. Plus, you will not receive your eBay fees back and you will receive a defect. If you refund on your own, you will be credited your fees.
There is the very small possibility that if you do fight the refund that eBay may give a courtesy refund to the buyer from their own funds and not penalize you but if it were me, I would not depend on that outcome.
I know it's frustrating but things like this do happen with online sales.

Yes, there is a 0.000001 chance they did receive an empty box. But the point of reporting them is that if they have multiple reports for similar claims, there is a very small chance that your report will be the one that puts their account over the edge, and their account will be deleted. (Very unlikely).
From there - Ask the buyer to send you pictures of the package and not to dispose of the box or the material. If it was inspected by customs, it should have some sort of information indicating it was inspected.
I would suggest taking a neutral and helpful tone with the buyer. Don't accuse them of scamming you. Tell them that if the package was tampered with, you plan to contact Fedex directly so that you can open a mail theft report. You may also be required to open a Police report for insurance purposes.
Let them know that they may be contacted directly to assist and provide relevant information, but that they should also contact you directly if they have anymore info. Instruct them to ask any neighbours, family members, or roommates if they saw anything.
I would then contact Fedex directly and ask them what their process is for reporting a tampered package. Explain that you sold an expensive+heavy item and the buyer is claiming that the box was delivered empty. You may be able to get weight scans that prove the statue was in the package after it left Fedex. USPS takes mail theft seriously. I am unsure what mechanisms Fedex has. They likely have the ability for you to open up an investigation that they can look into in order to figure out what happened.
At this point, one of two things will happen. If the customer is scamming you, they might get spooked by the prospect of Fedex and the Police getting involved, and you will get a message saying "oh it turned up my husband opened it and didn't tell me!" - or you will get some actionable information from Fedex.
When you get information from Fedex, what you need to do from there is take that information and contact eBay directly. I would use the "AskEbay" Twitter or Facebook page. If Fedex is able to indicate to you that the package was scanned at full weight, that means it is very unlikely that the statue was removed by customs or Fedex. eBay will likely instruct you to provide them with a return label, and to report the buyer. If you have rock solid proof that it was delivered at full weight, eBay MIGHT reimburse you for your refund after you receive the empty return and refund the customer.
You will likely have to ask the customer to return the empty box as it was sent to them, and proceed with the return. The way eBay works is that sellers always need to proceed with returns. The only way you won't have to provide a label and accept a return of an empty box is if through reporting their account, their account gets suspended, which will then cause the return to time out. I have only seen this happen once. It takes a buyer already being on eBay's radar for your report to put them over the edge.

CONCLUSION:
The buyer went to their local FedEx location and found out that the item was LOST by Fedex themselves. The openly admitted it and marked it as such in their system and told the buyer to tell me to put in an insurance claim. I did so, and the cheque came within a week... no hassles at all. The very next day the item (a 12 inch high statue) showed up at my place. Before I first shipped it out in a box, I wrapped it in some old bubble mailers. One of the mailers still had my address on it, so it ended up coming back to me. After unwrapping it, I noticed it was missing its head. I suspect customs must of dropped it after taking it out of the box to inspect it.
PS: anyone interested in a headless statue?

Wow.
Two great take aways from this.
Don't treat the buyer like a scammer, because even in a scenario like an empty box that is 99/100 times a scam, there is always that 1/100 times that it is not.
Always include an addressed invoice inside the box of high price shipments. If the outer box is lost or damaged, it increases the chance of delivery or return.
I would display it, it makes for a great story...
