I had the ebay set to time away for the long weekend and someone placed an order on an item while i was gone and requested it be cancelled but since 3 days have passed since the request I am no longer able to respond to the request and i am unable to cancel the order myself because it says a cancellation request is already in progress. Is there any way for me to cancel this for the buyer?

Try contacting eBay directly, they should be able to manually cancel it for you. Most people prefer the Twitter/Facebook customer service that can be accessed through messaging the AskeBay account, but the phone customer service should be fine for something like this.

the agent is saying we can just send the buyer a refund and it will automatically be taken as "cancelled". This makes no sense to me as the order will still be there and I don't want a defect

I asked if that means the order is still active and awaiting shipment or not because i dont want a defect and they said "Nothing to worry about at all as once this order has been refunded, it will be taken as cancelled and no action is needed to be taken on it after. It will not be active after that"

If you do this, it's very likely you will receive an out of stock defect.

Thats what I thought, we just ended up sending to the buyer so they can do a return because there was no way to cancel.
