a seller has taken over $700 for a hot toys hulkbuster and its been 6 months

How can I get a refund and report a seller. Its been more than 30 days. Ebay says it can not help as its been more than 30 days. Seller keeps saying he will send the item. It cost Over 700USD. Is there anything I can do?
