Ebay purchase of Core 12 person Tent Return

Hello Friends,

 

I Ordered 12 person tent from Ebay on 29th June under impression that I am ordering new Tent.

After day 1 or 2, I realized that I ordered used Tent. so on 3rd July , I thought let me reject the order. but I didn't find any option on portal except return item. so, I click on return item with option as "wrongly order item". but very next day seller has closed the request. so i thought it might be because Item has not received yet so according to system they have closed the request. Then I have no option to wait till receive an item. I received item on 12th of July and i found that Item was broken. I contacted seller and told him about order and he realize the trust and ready to refund my cost. After then he realized that it's international shipment so he denied to print a return shipment label. so i raised this request with Ebay customer care. I explained my case to their representative and they said use return item button on your order form. but, I told them that "i tried that option but it says that your return request is closed". so customer care requested me to open ticket with paypal and said they will help you in this situations. then I logged dispute case with paypal and they settled my case and asked me to shipped item and provide them tracking number. I have asked them for shipping label then they said they are liable to provide return shipping label. so, I contacted ebay customer care , then they said we can't do anything in this case as case is already closed. so any one can help me out in this case? How do I escalate my case?

You bought a used tent on Friday June 29.

You paid.

On June 30 or July 1, you noticed that the tent was not new.

If the seller is in the USA he would have been able to ship on June 29, 30 , or July 1 since USPS works on Saturdays.

You tried to cancel the order.

 

I didn't find any option on portal except return item.

You can't return an item you have not received.

 

The tent arrived on July 12.

It was broken.*

Uh-huh.

You requested a return shipping label for the unwanted tent.

Now, while you might think this was a Not As Described dispute, because the tent was 'broken'*, your previous request for a cancellation makes it pretty obvious that you were having Buyer Remorse for misreading the listing.

 

You are responsible in cases of Buyer Remorse, for returning the unwanted item to the Seller with tracking.

It won't be cheap, but if you sign up for the Small Business Solutions card**you will get a 5% discount on most shipping services. Tracked Packet USA is probably the cheapest.

When the tracking shows delivery (not shipping, delivery) the seller is required to refund your original payment.

 

I logged dispute case with paypal

Although Paypal allows 180 days for Disputes, they ALWAYS  require that the buyer pay for return shipping.

 

Remember the original problem was that YOU did not read the description carefully and ordered the tent without understanding that it was a used product.
