I just bought a watch , seller didn't mentioned "as is" status and watch is broken and considerably different than auction pictures , scratch on lens and pretey beaten up.

I emailed seller about it , he wants me to shipp it back and he will refund the cost of the watch and here is the kicker , shipping back tracked is pretty expensive and if seller only refunds the price of the watch I'm in the hole for innitial shipping , customs and return shipping. All in all I think I got shafted by innacurate description and seller not chacking the actual condition of the watch before he sold it.

What do you think my options are in this situation ?

File an "Item Not As Described" dispute.

You will still be required to return the item to the seller, with Confirmation of Delivery and Signature Confirmation if the value is over $250, but you will be refunded the entire original payment when you can show eBay that the watch has been delivered. (NOT shipped, delivered.)

When you return the item, mark it as Returned Merchandise. On the back of your original receipt for the shipping and duty and tax, you should find the phone # for CBSA. If not they have a website.

You can be refunded the tax and duty on returned merchandise. You will not be refunded the service/brokerage fee.
