Items missing from purchase and seller has not responded to my requests.

I purchased a multiple season DVD set and Season 7 was missing the 6 DVDs.  Each season was individually wrapped and then the complete set was wrapped together, therefore I believe it  came that way to the seller, but regardless, I feel I should be able to receive that Season's DVD's.  I have contacted the seller, via ebay, twice and have received no response.  I cannot open  a case with ebay as it is passed the number of days.  How is the best way to deal with this?

If it is too late to make a claim through eBay/PayPal and the seller is not answering email inquiries, why not call him?
