You can't reopen an eBay dispute, but you are also covered by Paypal's Buyer Protection and by the chargeback policy of the credit card you use to back your PP account.

The good news is that Paypal allows 180 days from Payment for disputes.
The bad news is that, no matter what the reason for the Dispute, the buyer pays return shipping.
So open the PP dispute, buy a return shipping label * , and return the phone to the seller.
When tracking shows he has it back, you will be refunded.
Keep an eye on that tracking number.
