Numerous Wrongful eBay Account Restrictions - Contemplating Legal Action

We would like to share our situation with the community and hopefully catch the attention of someone at eBay who can help us resolve this problem once and for all!

 

My company name is Luxuria & Co. and we are a Canadian Corporation that specializes in the online resale of high end designer apparel. Our main selling platform has been eBay since 2007, username luxuriaco. Since 2007, we have made 2251 transactions, averaging nearly $3000 USD a month eBay fees. Most importantly, we are a top rated power seller according to eBay’s own seller standards; we have a flawless record with 1200 positive feedback and a 100% buyer satisfaction rating.

 

Over the past 18 months, eBay has begun erroneously flagging and removing our listings at random as well as restricting our selling privileges. Despite eBay’s acknowledgment that our listings were indeed flagged and removed erroneously through countless emails and phone conversations, and despite the fact that our listings were always reinstated due to these mistakes, the sanctions have still become increasingly severe. Today our account is not only restricted for a limited period of time, it is restricted indefinitely.

 

To date, eBay’s inability and unwillingness to address these issues has caused us to loose countless sales and business opportunities. It has also had a serious impact on our reputation with current and potential customers who are following our store and watching our listings. We are at wits end and our confidence in eBay’s selling platform is dwindling.

 

These persistent issues have forced us to start gathering countless emails, screenshots, and call recordings in order to document the whole ordeal. We are fully invested in this business, our livelihoods and those of our staff rely on it, and it is outrageous that it can all be destroyed at any moment by false accusations. We want to be secure and confident that the platform cannot simply restrict us at any moment based on a mistake by their faulty algorithm, untrained staff or even based on a malicious report by a disgruntled competitor, in order to keep growing and reinvesting in this business.

 

We have tried unsuccessfully on numerous occasions to reach management and leadership groups in North America by phone, only to have our calls re-routed to calls centers in Southeast Asia. We can never get any clear answers or sincere assistance even after countless calls and hours spent on the phone; only generic answers and blatant lies and denials. We have always respected and upheld eBay’s rules and policies, always offering the highest standard of goods and service over the past decade, as our seller dashboard record shows. Throughout these tribulations we have tried to reason, appease and comply, always cooperating fully and making any changes necessary to exceed eBay standards and requirements. We have gone as far as offering to have external authentications done at our own expense and have also recently partnered with Entrupy, a world leader in authentications that has us listed as a certified seller on their own website!

 

As eBay sellers and buyers we are not only community members, we are also partners and clients, we have contributed to building the eBay platform and brand and paid hundreds of thousands of dollars in fees for the privilege. As such we expect a minimum of courtesy and diligence from eBay. At this point we have already lost a week of sales due to this most recent wrongful restriction. We are now contemplating legal action and feel we have a solid case.

May be able to help you.

I think you are talking about VeRO restrictions which usually start with robo-flagging of brands which are enrolled in the VeRO program.

Have you been in touch with any of the brands you sell to get their specific permission to resell their products? Some just want to monitor, mostly for counterfeits, and others do not want their products sold by anyone but authorized dealers.

I also notice that while you are posting to the eBayCanada board, you give the product location as Switzerland.

And you are actually selling on the eBay.com (original/US) site.

 

If you are in Canada or the USA, you may be caught up in a dropshipping scam. The products you have been selling may not be what you think they are because your Swiss supplier has been substituting.

Hello,

 

eBay is flagging us for alleged trademark violations, despite our flawless record and being a certified seller of authentic goods. The main issue is that even though they have acknowledged on multiple occasions that there is a problem on their end and that we where flagged by mistake, no one takes heed of the prior history and notes left by management to this effect, and reaching a person who is high enough in the eBay organization to care is extremely time intensive and frustrating. In the meantime we loose thousands in sales and faith in our potential to grow on the platform each time a restriction is placed. We have faced this same issue over a dozen times over the last year.

Thank you for your insight. These are not VERO restrictions. All our merchandise is legally purchased and owned by us, we acquire, inspect, photograph ,list each item of inventory and ship everything ourselves. We are 3 partners running everything from A to Z. Like I said eBay has already admitted the issue being on their end and apologized verbally and in writing, as well as reinstating the removed listings after each mistake. The issue seems to be a disconnect between the management in the USA and the bots/under-trained teams that flag the listings In SE Asia. These restrictions always occur around 4-5AM ET.

Just a quick update on our case.

 

After endless phone calls and emails, eBay finally lifted the restriction, reinstated our items and admitted to their fault. This took over 2 weeks to resolve.

 

Not even 8 hour after being reinstated all of our listings were taken down and here we are again back to square one, back to endless phone calls and emails.

 

We're upset, we're exhausted, but all of this evidence and admission of guilt is only making our case against eBay stronger.

 

eBay now asked for 24 hours to fix this issue "once and for all" but we have little hope in their ability to fix an issue "once and for all".

 

So here we go again, another day without sales and thousands of dollars lost because of eBay inability to implement a viable solution.

I sure hope eBay compensates you for all the time & trouble & lost sales. That would be a gesture of good faith.  Hopefully a couple of free months of your store subscription fees or some free listings.
