Paid $250 total for an item (with shipping inc.) and seller put value of over $300 on custom form

The response from the seller

"Dear Sir/Mam
The query you asked is according to the rules of eBay by default.
We don't import any taxes or extra prices.
Regards"

the value should be less than $200 since the price includes the international shipping but the seller is saying eBay puts value of over $300  ,I'm paying higher import taxes due to this ,why would eBay rules put the import value higher than what was actually paid?

Do you mean the seller priced the listing as $200 plus $50 shipping?

Or as $250 with Free Shipping? (and you calculate the value of the shipping to be $50?)

Either way, the import fees are on the purchase price, not the payment you made. The seller is supposed to declare the purchase price.

You can contact CBSA with your invoice and get those import fees reversed.
I won't promise it will be fast, but since you are over the $150 duty free and $40 tax free allowances, it may be worth spending the time- remembering that time is money.
