Would a duty free item would have been subject to that 25% hike?

I read something on a FB group that made me think a bit... If something was not subjected to any duty before this fiasco, would it stay duty free or that 25% would be added on it? That's a question for the American side, not ours, but I'm really curious... The argument was that while tariff can be levied by an executive order, duty status are made by laws, hence not subjected to such orders.

 

Some comic book artists are selling their original art to US customers, so there would be an impact for them.

 

Original works of art (i.e. paintings, drawings, pastels, collages and decorative plaques) with or without their frames are duty-free under Chapter 97 in the Harmonized Tariff Schedule (HTS).
