I contacted seller about the product and want to return it. They said i don't need to returned it and they will mail a new one to me. It takes about a month to mail it. Should i start a dispute?

Hmmm, you're in a tight spot.
The seller most likely has no intention of sending a replacement item. The 'promised replacement'
is a delaying tactic to prevent you from doing anything.

At $52.99 US, the seller will not be sending you a second one.
Sometimes a new user like yourself never gets the first item, and then is sweetly told to wait a bit
longer, or that a second item will be mailed.
Once that 45 day Resolution deadline has passed, that seller will ignore you completely.
Today, you are on day 39.
However, if you are unhappy with the first item ("not as described") according to ebay policy you
will be required to mail it back with Delivery Confirmation at your own expense. It you are mailing
it back to Hong Kong, that could cost you at least $70+. You can see the rates at Canada Post

Delivery Confirmation is what is required in Resolution Center claims, to show that the buyer got
the item, or the seller got it back. Ebay/paypal will not entertain a claim without this.

So it's highly unlikely you will receive a replacement. You do, however, have 60 days in which to
leave feedback. If you look at the sellers other negatives, a lot of people are unhappy with the
products.
In future, know how the Resolutions system works, and read the seller feedback. If a lot of people
complain about poor quality items, you are gambling if you are hoping to be lucky.
Whether or not you see rolling the dice as 'fun' is up to you.
