Hello 'cheyenne...',

I understand your indignation, I truly do.   But right now what you want to focus on

is how to get compensatory restitution.

These message boards are "member-to member" boards and no ebay staff are available to

discuss this with you.  All the people on these boards are simply other ebay users like yourself.

If you have not already done so, I urge you in the strongest terms to read the following link

from top to bottom.  It is very easy going in plain simple language and won't take more than

two minutes of your time:

http://pages.ebay.ca/help/buy/item-not-received.html

This link explains all about what to do when you are not getting an item.

Based on your posts here, it sounds as if you paid with a paypal account backed by a credit card.

Because you won the auction on April 12, and it is now only April 14, the automated ebay

computer system may force you to wait a few days before you can proceed with a claim.

It has only been 2 days.  That means you have not yet 'lost' your money, because as you will

see from the above link, you have a full 45 days to initiate a claim for a no-show item.

Again, I will ask you, -- when you access your Purchase History page from the My eBay at

the top here, beside the listing title for the ring -- what does the little blue dollar sign look like?

Is it a solid blue?  Or is there a little 'reverse arrow' over it, pointing to the left?

When you see that 'reverse arrow', it means the payment has been reversed.

You can verify this from your regular email.

Again, -- in your regular email (be it hotmail, shaw.ca, or whatever you use),  do you have an

email from  service@intl.paypal   which announces  Your paypal payment has been refunded  ?

When that arrives, it means the seller has refunded you.  It may, however, take a few days for

the money to finally reappear on your credit card.

Call the 1-800 number on the back of your card  "To hear recent transactions to your account".

Keep checking to see when the amount has been credited.

It seems to me that both you and the seller made some errors.  That listing was obviously badly

done but as you were her first buyer perhaps she, too, needs to quickly read through some of

ebay's survival links.

If you read through the link I posted you will see that you are indeed fully protected from any

type of fraud.  I understand how frustrating it can be to get a lovely item at a great price, only

to find out that there was a 'mistake in the listing' and you are not going to get it.

This happens.  I suppose it's sort of the reciprocal of people who win auctions and don't pay,

thus infuriating the seller.

I am sorry that you have to let your daughter down about this, but perhaps use the situation as

an occasion to explain about life's disappointments and the importance of safe-guarding your

money and learning about company policies that prevent things like fraud.

In this case, what happened may be not fair and certainly no fun, but it truly isn't fraud.

If you follow ebay policy, you will get your money back.

Then, after you have done that, find the words Customer Support  at the top right of the page,

and choose the Customer Support link.  You will get a phone number and time code you can use.

Call ebay, and speaking very kindly and calmly to the telephone attendant, get that 'false positive'

removed from your feedback.  Sellers are not allowed to leave such negative comments for buyers,

but your seller probably does not know that.

It might be nice if you also have that negative removed, - the one you left.

After all, both you and the seller made mistakes and you both need to better familiarize yourself

with ebay practices and policies so as to greatly improve your ebay experience.

Everyone makes mistakes, especially when they are new.

Getting your money back, then cleaning up the mess would be best for both of you.

Good luck.
