Item needs to be resent. Should I open a case so I'm still within the time period of opening a case?

I paid for an item and the shipping was suppose to take 9-17 days

It has been about 20 business days and I didn't receive it. So I contacted the seller
and he says it got sent back because of customs trouble and said he'll resend it.

My purchase history has a note that says

"If there was a problem, please go to the Resolution Centre by 30/04/14."

So am I suppose to open a case right now in case it gets rejected again or will I still be ok if I open a case after April 30th?

I would open a case now.

 

It is your money no matter what the seller says.
