Have you filed a formal Claim?

There is no need to get the Seller involved.

If this is a Not As Described Claim the seller will be told to refund but has the choice to send you a return shipping label and refund only when the purchase is back with them.

With a Not Received Claim the seller will be told to either provide Proof of Delivery or to refund .

If the seller does not refund voluntarily eBay will refund you and go after the seller for their money.

 

The Claim is made from the original invoice you recieved.

Look at your Purchases under My eBay at the top of most pages.
