I think this is so unfair. The problem comes from the fact that my international (European buyers) open claims against me a couple of weeks after buying items that I CLEARLY listed as taking 5 to 8 weeks to reach them. I even write that they should NOT make a purchase from me if they cannot agree to this delay. Yet many of them open cases as soon as 10 days afterwards...and now I lost my TOP SELLER status because of it. I sell magazines and they leave by surface mail. it is the cheapest way for the buyer but it can be slow. How can I better protect myself against unjustified claims ? European buyers represent 50% of my magazines sales but I think that if I were to charge $25.00 to send a magazine by Air Mail to Europe my sales would drop.

I think the answer is to just stop using cheap shipping methods & start to use tracking & insurance.
This has happened to me a few times where they put in a claim and there is no tracking number, then Ebay decides that since there is no tracking number, to give the customer a refund immediately. Ebay won't even wait for the time period stated!!!
Since I changed my shipping methods, I have lost a lot of sales. But at least I am no longer being ripped off by the few who have now spoiled it for the rest!!! I mentioned this to Ebay, but they don't care!

All of this is irrelevant because it is superseded by your eBay and Paypal agreement.
If your buyer does not receive her zine (or any item) within 45 days, she has to file a Dispute to guarantee a refund. If you can't prove delivery, and you have another 20 days for that, she gets her money.
So your basic error is-- you are shipping by Surface Mail.
And the answer to your question is -- stop shipping by Surface Mail.
If you use Air Mail, even without Confirmation of Delivery, the claims will stop.
And before you go whining that your overseas sales will stop, remember that right now you are shipping overseas and losing the item and your payment and the cost of shipping.
Some sales are not worth having.
