Is this discussion on now?  In any case,I have a question: why do the Lithium moderators move all the GSP-related posts into the two tacked threads for comments and questions?  A lot of people are not used to the boards. If they come here with a specific GSP problem they're having and their thread is subsequently moved into one of the mega threads, how likely are they to find it again and find the answers to their problem?

 

From where I stand, it looks like the mods are more interested in making it look like Canadians don't dislike the GSP as much as they actually do than they are in helping posters get their answer.

The moderators are moving the GSP-related topics into the consolidated threads at our request actually. We are doing this to ensure that the US-based GSP team knows where to look for these comments from Canadian buyers. So far this is the best way we were able to raise awareness on how the program makes less sense for Canadians than it does for buyers anywhere else in the world.

I should also point out that when a topic is moved, there is a link to the new location that remains where the topic was originally posted for 48 hours, specifically so that the author and whoever else followed the discussion can still find their way to it.

Slow day today.....

 

Question about the eBay/PayPal Buyer Protection Policy.

 

If a buyer purchases a $100 item arriving in damaged or unsatisfactory condition - the buyer files a claim for "goods not as described".

 

eBay/PayPal finds in favour of the buyer.  The seller stated in his listing that no returns are accepted.

 

What happens next?

 

Is the buyer obligated to return the damaged item to the seller who does not want it back?

 

Are the rules identical if the item is listed on eBay.ca and/or eBay.com?

 

Are the rules identical if the item is purchased on eBay/ca and/or eBay.com?

 

Are the rules identical if the seller used GSP?

 

When will the buyer get his/her money refunded through PayPal?

It depends on what protection program the sale falls under. Under the PayPal program, it is up to the seller to request the item back or not. Under the eBay program, usually the system will prompt the buyer to return the item.

Yes.

No. Currently, if the item was purchased on eBay.ca, the sale falls under the PayPal program. If the item was purchased on eBay.com, it falls under the eBay program.

Yes, keeping in mind that GSP transactions usually fall under the PayPal program.

This happens when the dispute process ends and the case is closed in favor of the buyer, irrespective of what program is at play.

What is the point of eBay asking the buyer to waste money to return an unwanted (damaged) item?

We cannot control what happens outside of the web site. The system may prompt a buyer to send an item back because in 99.9% of the the cases, that's what the seller will want. In the end, if the seller decides they don't want the item back and still honor their commitment to make it right and refund or send a new item, it's up to them.

 

What I have seen happen sometimes is the seller only requesting photos as proof of damage, which I believe is also acceptable under eBay Buyer Protection.

 

In any case, both protection programs only provide a platform for buyers and sellers to resolve disputes in a standardized way. How this ends up happening is up to the members themselves.
