Don't worry about it.
The process is pretty well automated and no human being is likely to look at it.
The seller will be notified that you want to return the item for a refund.
If the seller says yes, you will be told to return the item with Confirmation of Delivery /tracking.
If the seller says no, you will be told to return the item with Confirmation of Delivery /tracking.
Once you can show that the item has been received back by the seller he can refund voluntarily.
If he doesn't, Paypal will refund you and go after him for their money. There will be other fallout for him.
Everything else is window dressing.
So.
File Dispute.
Show tracking on return.
Show receipt of item.
Get refund.

I thought that eBay did not want counterfeit items returned to seller? If the submission didn't contain that information, shouldn't the OP call eBay? Or would it be PayPal?

In most cases there is no way for ebay or paypal to know if the item is definitely counterfeit. I think that in the majority of cases, they would still require the item to be returned.

I think, and this is not an informed opinion at all, that the entity to advise of counterfeit items being sold on eBay, would be the real manufacturer/distributor.
They have the wherewithal to do a proper investigation and to take steps to end the fakery.
