On Mar 27, 2013 I sold an item on E-bay marked as a presale. I 100% secured one but I did not have one in hand. So I put it on E-bay since the shipping dates started April, 9th and expected to have it before 30 days was up.
A few days ago this huge delay popped up on the website saying it would be delayed until August/September. On my E-bay listings I put "This is a presale. This (item) is suppose to be shipped mid to late April. Any delays the (production centre) has in production or shipping is not my responsibility. As soon as it arrives I will ship it out.".
I got an E-mail from the guy/she he bought the item yesterday saying how I said 100% that I would ship it out in April which I did not and how people already have it that I need to refund his money. This was in respond to a previous E-mail I sent him about the delay 9 days before.
So I contacted E-bay and he said that he looked over the listing and said that everything looked good so there should be no reason why I would need to refund him because of the delay and how it is already released and people have it. He told me it was clear that I said it could be delayed.
So what do I do? Refund him or just see what happens? I will get the item and I will ship it out but I do not know when.

Or, delays will go into infinity and you will never get the widget. Refund and relist when you get it.

How long do expect to make interest off the buyers money without shipping an item?
Making the buyer wait until September is totally ridiculous and reeks of a huge scam !

That does not make sense.
Either that customer service rep should be fired for incompetence or you misunderstood what he said.

"Guarantee that the item will be available for shipping within 30 days from the purchase date."
There is only one thing for you to do: REFUND THE BUYER IMMEDIATELY.
