This is what I received from Ebay , also saying that the seller does not have item in stock . The problem is that my payment was not cleared by Paypal yet , however money was already taken from my bank account and now the seller is backing out of this sale .

What should I do ? Just agree to cancel the sale and wait for Paypal to refund my money ? Or wait for refund and then agree to cancel sale ?

First contact the seller and ask for your refund.

When you pay from your bank account it works like an echeque, and while your bank has removed the money from your account, it has not yet been cleared to your seller.

So it may take a day or two for him to complete the refund.

As soon as the money is back in your account, agree to the cancellation. Let the seller know that you will be agreeing.

This kind of Mutual Cancellation does not affect either buyer or seller. Both can leave appropriate feedback.

Everything went as you described, I just got got refund confirmation , agreed to cancel transaction , as for feedback ...I dont know about that ...they wouldnt want to hear what I have to say about them selling the item to someone else while waiting for payment from me 😉

Did he tell you it was sold elsewhere? That can happen if a seller is using multiple venues and not keeping very very careful records.

However, it also happens to dropshippers, who take your order and transfer it to a depot from which it is mailed. The seller has no idea how many of the item are left. He also probably has never seen his own product and has no control over packaging and shipping time.

Glad your seller was cooperative.
