Have not received Product I bought over 2 months ago

I've bought an anime movie set out of Malaysia on January 26, 2016. I was told delivery was early to late February. I wrote the seller on March 8th asking that they track the package. I was told it was it was in the Vancouver processing centre so I thought it should be to me in Alberta Canada in about a week. I have STILL not received it.

 

I've had to track the seller another way since the email address for that purchase is no longer valid - I wrote them on Monday and have not received a response. EBay tells me that I am now outside of my 30 day money back guarantee through EBay. And I can't even leave a **bleep**py feedback post for the seller since the time to do so has expired.

 

My son gave me the money to purchase this movie set for him.  How do I go about trying to either set the movies or his money back now?

 

PLEASE help me. I've purchased numerous stuff on EBay - even from Malaysia - and have never had this issue. Where do I go from here?

You will need to open an item not received case. You can open the case at http://res.ebay.ca/ws/eBayISAPI.dll?ResolutionCenter.

You are past the deadline for eBay's Buyer Protection, but you are still covered by Paypal. Go to your PP account. The Resolution Centre is at the top of the page hidden under Tools.

 

Open an Item Not Received Dispute.

You may be encouraged to contact the seller. You have already done that so escalate to a Claim.

If the seller cannot prove delivery (not shipping, delivery) he is required to refund. If he does not do this promptly, within 24 hours, PP will refund you and go after him for their money.

 

Do NOT accept an offer of a replacement. It won't arrive either.

You want all your money back.

 

A couple of questions.

Did the seller give you the tracking number so you could track the purchase yourself? If he just told you it was in Vancouver, he may have lied.

When you say the seller's email address is invalid, is his account also Not A Registered User? If so, mention this in your claim. It will speed things up.

If it is just the email address, you can Report it to eBay as Invalid Contact Information.

Did the seller leave feedback for you?  You can add a Response to any feedback, your own or the seller's, indefinitely. The most effective Responses are calm and factual. "Paid Jan 26. Not received. PP refund Apr. 10" for example.

The first mistake you made was asking the seller to track the package and accepting his version of where it is.  What you should have requested was the tracking number, plain and simple.  

After all, if he has a link and number by which he can ascertain the location of the package, he can easily pass this information on to you.  Instead he just told you it was in some Vancouver processing center (not Richmond?) because he has heard of Vancouver.

That is because the seller thinks you cannot do anything about it, now that he has delayed you past ebay's deadline.  For future reference, be sure you are aware that ebay provides 30 days after the last estimated delivery date to file a claim.  If you have not already done so, have a gander at the following link:

However, the ebay deadline has passed for this item but, . . .  Hooray for Paypal!  because paypal gives you 180 days after you paid (nearly 6 months) to file a claim for item not received.  This next big blurb explains that in Section 13.5, and there is a link to the Resolution Center you can use:

If, on the other hand, that is of no help for you and you paid with a credit card, you can always call the 1-800 number on the back of the card and inquire about a chargeback.  You will need to have the card statement, any receipts, and those 'delaying tactic' emails from the seller,  and it all takes several weeks, but better than losing money to a scammer.

That can be disheartening, yes, but look on the bright side, -- when you leave bleepy feedback for a seller you also leave it for yourself in your outgoing feedback, so much as you would like to post that well-deserved neg somewhere for him, the most important thing now is getting your money back.  

In future, keep in mind you only have 60 days after you buy an item in which to leave feedback.

You cannot get the movies, at least not from this seller.  I would suggest you not ever buy from this seller again.  And since we're on the topic, -- never accept a promise of a replacement item.  Even if the item has not arrived and you contact the seller, - when the seller assures you he will send a replacement instead of a refund, -- file a claim for your money and do not ever close a claim until you have either your item or your money in your hand.

Do it now, and don't waste another minute.
