How can I claim for fraud after 45 days of buying a product, when I noted it?

I have bought a camera polaroid described as new and under polaroid warranty x 1 year. I received a closed box and a new camera with all the accesories. I have been usong the camera without any problem for the last 85 days. Now the camera is not printing properly so I want to send it back to Polaroid to be fixed. I realized -when asked by polaroid - that there was no warranty card in the box. The seller is no more a registered user since I bought my camera,  as I could not leave a feedback! The seller didnt answer my emails and it is late for me to open a claim, but this seller made a fradulent action, as polaroid said to me, that there is no unopened box with warranty card.
What is my next step to claim? Why this is no longer a registered member? Has he been fradulent before and I am a victim who noted that later? 
Please let me know how to proceed.

Correction: " there is no unopened box WITHOUT warranty card" by Polaroid support center.

So my box was not unopened, just looked as one.

Was the warranty stolen by the seller??

Hi isoler.. There is nothing that can be done at this point. You needed to address any deficiencies on receipt of item.

PS ..Your item was not as described. Purchased from a seller with 5 feedback who may have opened and registered the warranty. Once registered , it is not transferable to someone else.

 

Sorry but you are stuck to repair.

I have to agree with heidilynn. Unfortunately You are stuck with the cost of any repair,if repair is possible. The deadlines for any help from eBay or PayPal have long since expired.

Many, if not most, manufacturers will not respect warranties for items sold by resellers who are not authorized agents.

Whether there was a factory error that left the warranty card out or whether the seller removed it ( I have trouble imagining why this would be a useful exercise), Polaroid has stated their position. You will have to find a camera repairman and pay for any repairs needed.

You might try Henry's, who are Canadian, widespread in Ontario, and eBay dealers. They sell refurbished products (as well as new) and would have the expertise.

Hello Lorena,

Well, you've heard the bad news.  It is one of the aspects of buying on ebay.  It is not like Sears online or something where someone must be held accountable for the product.  It's more of an online garage sale.  So if you bought the camera at a local garage sale from someone who assured you it was new and all that, - do you expect you would have any recourse at this juncture?  If warranties are important to you as a consumer, then you need to buy those types of items at a local retailer. 

Chances are, your camera was not new.  Or maybe it was, but had been out of the box, examined, and returned to the box without the fiddly bits of paper.  I don't know how extensive the warranty would be, but if you read the fine print on most you will be expected to mail it to a certain location at your expense, and whilst parts would be free you may be required to pay for labour.  There is a clause in most warranties that they will cover the costs (but not mailing) only if there is a manufacturers defect.  It would be very easy to assert that you mishandled and subsequently caused the problem.

None of which fixes your camera, I know, but in truth even with a warranty card there is no reason to believe it would have been repaired for free.  People become 'No longer a registered user' for many reasons, - sometimes they just clear out the attic and then cancel their account.  Or sometimes they get booted off for dodgy dealings.  If you like the camera, about all you can do now is find out what it would cost to have it repaired locally.
