Not sure what to to about a purchase.

I purchased a pair of shoes on Feb 2nd, Paid on the 3rd and the seller marked the item as shipped.

On the 42nd day I opened a dispute on paypal after having no luck getting an answer from the seller. The seller never responded to the dispute so a week later paypal refunded the money. Today the shoes arrive at my door and not in the condition they were discribed and I honestly dont even want them. Im not sure why the seller waited a month and a half to send them and didnt respond to any of mine or paypals messages. Should I send the shoes back?

I second that. Figure out a cheap way and ship the shoes back.

IMO the answer is not that simple and one of those ethical dilemmas that we come across so often with this kind of buying and selling.

I had a similar situation where the seller ignored me and ignored me and forced me to open a case.

After 2 months the item arrived and it was very damaged.

As in my case, chances are the seller has already collected insurance on the item.

The question is: .......... what is your obligation to a seller who shipped you garbage and then ignored you when you contacted him or her and forced you to turn to outsiders for help?

If you do decide to ship the shoes back make sure that the seller pre-pays return shipping.

You are not entitled to have both the item and the money but on the other hand, it isn't fair that you be out money if the shoes were misrepresented. But.. if you had received them earlier and had filed a SNAD claim with paypal..you would have had to pay for the return unless the seller offered to pay.

You could contact the seller and explain that the shoes are now there but not in the condition as described and if the seller would like you to send them back, you would be happy to do so and will let them know how much the shipping would be. Basically...you'll send them back at their expense.

I would only consider doing that though if I thought that the shoes were definitely not as described not just because you don't want them now.  You don't know if they took so long to arrive because the seller waited to send them out or if they were sent out right away and got hung up in the postal system.

I would not assume that the seller had already collected insurance as someone else suggested, especially if the seller was in the U.S. as insurance is not included with postage and it seems that few U.S. sellers buy insurance.

I did say that it could have happened............  and in light of your post I now see that I should have included even more qualifiers........... 😉 such as:

There is always possibly maybe could be a possible chance the seller has maybe already possibly collected insurance.

Check the method of shipping for clues.  :).

Other than that, you're post was essentially the same as mine.  :).

hmmm...I'm not sure why it matters but no...I said that it was 'suggested' meaning that it was offered as a possibility. Then I suggested that the seller may not have had insurance.

hotpink........ Check to see if the item was shipped with an insured method of shipping.

If it was then the seller will probably already have collected the insurance or be in the process of doing so.

If so............

Well........ no seller is going put that milk back into the cow......... 

That information should be relevant to your decision re what to do now.
