I purchased an item from a seller on 8/21/14. The buyer provided a tracking number but their post office doesn't support tracking to my country and my country's post office has no record of the tracking number.
After one month without receiving the item, I contacted the seller who stated that the item was lost despite the tracking number and asked if I wanted a replacement set or a refund.
Preferring the item over the refund, I asked for a replacement which they said they would send. This was on October 6, 2014.
It's now November and I still haven't received anything. I've tried contacting the seller three times in the past week and have not heard anything. The seller is still selling the same item, so I know they have at least two copies of it.
I can't seem to open a case on eBay as I'm assuming it's because it's past 45 days and any attempt to do so just leads me in circles. A case on PayPal seems to do nothing as they state it's after 45 days.
I'm at a loss for what to do next and I'm out $200 CAD. Any suggestions?

If you paid with a credit card through paypal you can phone your credit card and do a chargeback. Other than that, there really aren't any options once the 45 day limit passes.

This is a fairly recent scam mostly from Asian sellers. It may expand.
There is no reason to believe that anything was sent. There is no reason to believe that anything ever even existed.
ALWAYS ask for a refund in these circumstances. It can be instant, an hour at the most if the seller has to skim through dozens of unhappy customers to find your payment.
If you still trust the seller, then you can reorder, which resets the clock to Day One.
As you were advised, call your credit card and ask for a chargeback. There should be a 1-800 number on the back of your card.
