Recently I had some problem with my buyer on this item 330118454746

Item arrived, but has some damage.
Buyer ask for full refund or send another one.

I feel it is not fair to me.
In my listing I said very clear, "we seller, CANNOT be held responsible for item damage during shipping because we simply have no control over reckless handlings at airports, or post offices."
And all my package is as described.

I don't know what should I do.

Any suggestion?

I mark all of my items with a marker that can only be seen under black light. When I ship an item, I state "Please note: do not wash your item until you are satisfied with the transaction as it has been marked for identification". I use my initials in my handwriting . So far, if anyone has asked to return, I tell them I will check it to see if the mark is still there and if it is, then I will refund. I have had a few people disappear after being told that and 2 have returned the item ... and they were the originals that I had sent.

Hey auctions_from_orbit...549us?? ouch! i don't know how i would handle that one. are you just guessing that the buyer is pulling this fast one on you? if not, how do you know for sure? if you really don't believe its yours, maybe you should try bluffing them once you receive your item and tell him you scan all your items and this one comes up as not yours. i don't know, its a stiky situation, and may backfire...a hard situation...let us know how it turns out and all the luck to you!

Hi Kat,

I am about 110% positive these items are practically indestructible in their original packaging. The inner foam storage for these crystals is form fitted so precisely that the piece only sits in the foam one way. There is no error when putting these back in the box. If you looked at the photos, you saw the leather bound wood box. The box is 14" long by 9" high by 12" deep. The piece is a little over 8" tall and about 4" wide. The entire contents is one big molded foam storage system that leaves at least 2" of foam between the piece and the box at any given point.

Next, the decorative outer box contains an additional 1.5" of foam throughout for when you place the wooden box into it. Finally I shipped with 2" of peanuts around my very shipping box once the whole thing was put in. There is a grand total of almost 6" of padding around the piece at any one time. I have sold about 100 crystals and have never had one break (and most of them are much more ornate and fragile than this).

There is one final nugget that was brought to my attention as well last night. The buyer told me the broken part had severe scratching from rubbing against the rest of the piece. The unusual thing about this is apparently 2 minerals with the same hardness on the Moh's Hardness Scale will not scratch each other under a simple test. In order for the broken pieces to scratch each other they would have had to have a prolonged contact with each other or heavy force would be required. The more I dig, the more I figure my initial assumption was correct.

Of course the ultimate test will be once the fingerprinting is completed.

And thanks for the suggestion nancyschina but I tried the marker when I first started selling these. The problem is the marker would not dry and would streak the piece. I have not found one that will stay invisible on glass so if you happen to know of one I would appreciate the name so I can order 10 cases of them 🙂

Yes, as soon as the item arrives I am getting it fingerprinted. The police do not charge for the service and the prints should be glowing bright if she handled the item. There would be no reason for her to take the broken item out of the container it shipped in, notice the break and then proceed to polish it with crystal polish... it would make no sense.

If the item would have been something less valuable I would just let it slide however these crystals are usually full of troublemakers.

It's almost out of spite that I keep selling them as I'm determined to make eBay realize they have to do something that protects the seller.

the question here is does ebay accept that as proof should the buyer open a dispute against you? would it be totally useless getting these prints? in the end, it is ultimately ebay that you would need to satisfy...?

Although I am sorry this happened to you, my suggestion is to move on. Don't let any one transaction consume you. I know how easy it is to get caught up in situations. Trouble is, it takes your focus away from what you should be doing and in the end, most often, its for naught. I know $90 is a nice chunk of change and would hurt most of us but, your health and well-being is worth so much more than that. Take all this time and energy you are pouring into this and re-direct it into something positive for yourself. I do however wish you well and do hope things turn out in a positive vein for you. Peace

Unfortunately it is a waste of time, effort, energy and money. Neither eBay nor PayPal will look at any such proof. You could have the heads of the FBI and RCMP bring it to them and I seriously doubt they'd take a second glance at it.

Sorry but they wouldn't. Unless you did it through the legal system, meaning the courts, supplying your own proof is meaningless. And such a waste of time!!

Hey I get losing a big chunk of change hurts. I was worried about a silly piece of makeup and a neg yesterday. Not even close to your kind of money but seriously though, put that effort elsewhere.

What you said in post 26 about forcing eBay to protect sellers is so....there are no words for that. Waste of time, foolish, bashing your head against a wall...I don't know but it's certainly not going to change eBay that's for sure. And I'm not meaning bend over and await the 2 x 4. I mean adapt to work within their system. That's what we all have to do.

It's like these people sending emails to not buy gas on a certain day or from a certain company. It's a wasted effort. It's not going to change anything. Work within the system as best you can for as long as you can.

Update:

Piece received from my buyer. The inner molded, form-fitted foam storage is shredded as if a cat was locked in the box.

I called powerseller support who referred me to PayPal. Paypal recorded the details for my protection in case the buyer files a claim. When the police are through with the investigation I will be given a case # which will supersede anything that results from dispute resolution in Paypal.
