PARDON? I shouldn't have bothered trying to be honest again with eBay as PayPal would have released MY MONEY TONIGHT!
eBay told me they would provide answer in 48 hrs. To This > Here's what happened > Apr. 7: Case opened against a case opened against myself > Comments > The buyer didn t respond to a picture request and didn t respond to a close case request. Please see my messages to buyer. Buyer is abusing program, claiming wrong item sent to get a refund. This is not true. As buyers item sat on my desk for numerous days waiting for payment. When payment was received finally, the correct item was sent, with tracking and delivered to the buyers address. No mistake was made on my part. The buyer has low feedback and Very Poor feedback as a seller. The buyer is being dishonest and is trying to hold an honest seller with Very Good feedback hostage. We have asked for more information from your customer to confirm the condition of the item received. If any additional information is needed from you we will request it through an email.
Now apparently they in there speak ( did got the right item ) but it was damaged. So now all they have to do is take a hammer to the item, photograph it and send to eBay so the seller gets His money and item confiscated.
Being an army brat I have moved many many times and became a very proficient packer. Probably one of the best on eBay. It has been commented upon in my feedback.
This whole situation has made me list less and become less interested in eBay as they bend over backwards to kick their customer the seller. How about you start rating your buyers and letting sellers know the buyers who claim item not received times how many times. Items returned times how many times. Feedback not returned times how many times. Bad stars given X how many times????? Help out your customer eBay. For now you can only go by who cares if they cancel their store and move on, there are 2 more behind him coming on-line. as word gets out you will have less reliability on that.

Okay, you have told eBay that you were willing to accept a picture of the damaged item instead of a return and the buyer has not responded.
It sounds as if eBay is giving the buyer a chance to respond-- and not everyone is on her computer every minute of the day and night.
The case was opened on April 7 and today is April 9.
Not even 48 hours, and into the weekend.
Chill.
If you wish you can demand that the buyer return the 'damaged' item instead of providing a picture, but frankly, I suspect the buyer was just trying to get a partial discount or a free item.
Your request-- and keep it polite, calm and professional, nobody cares about your emotional state, this is business-- was more than reasonable. If you wish you can escalate the request and tell eBay and the buyer that you will refund the entire payment (don't panic!) when the item is returned to you.
You should remind eBay that you are in Canada and that you cannot under the terms of the Universal Postal Union Treaty, provide a return shipping label but that you will also refund the buyer's shipping cost on receipt of the returned item.
What you are doing is making the buyer work for his refund. And a scammer won't.
But meanwhile, go enjoy the spring sunshine, or the last blizzard of winter, depending on your location.
Your unhappy buyer is being given a chance to respond.
It's business, not personal.

Very confusing timeline
Sometime in March-- order recieved.
Some days later in March-- order paid.
Shipped with tracking.
Tracking shows delivery.
March 19- Buyer tells seller there was nothing in the package. Or was an eBay Dispute opened by the buyer?
- Seller asks for picture of contents. No response.
March 20- Seller asks if case opened by accident and asks that case be closed. No response.
Undated- eBay informs seller that the case is on Hold until April 12 for further information.
-eBay informs seller that he can refund and the case will close immediately and he will not be held at fault.
April 7- Seller opens case against buyer -- grounds unclear.
Some questions and comments
Personally, I think the lack of communication is because the buyer is trying to get a refund in whole or in part and wants to keep the item, which is working just fine. It is doubtful, if that is the situation, that any hammers would be involved.

I had two items not recieved claims i sent the money back to the customer and ebay still gave me demerrit points they tend not to tell the truth most of the time,actually all the time lol,

Exactly, so if I bid on an item and lose, then the seller contacts me with a second chance offer because the high bidder cancels or doesn't pay, I have no idea how much the high bidder ran up the auction. Why would I taker second chance offer? As a seller I was screwed 3 times buy a Chinese bidder who I blocked then he used a new account each time and I don't even sell to China. Had to relist 3 x. I offered 2nd chance a few times early on when I got screwed, no takers, don't do it anymore, just relist. 2nd chance seems to Hoaky. What I could do is force payment which I don't, but if I sell small item without tracking and force buyer to pay guess what, claims didn't arrive. Sellers have little to no protection. You have to sell everything with tracking. Many small or less expensive items are not feasable this way.So it is sell at risk. Luckily most buyers are honest. But I also thought this morning, just by posting here I put myself at risk from scammers who could be following these threads looking for easy targets. But also any sale without tracking is at risk.

It's a privacy issue. When buyers file a case they are doing so in private...not on a public forum. But even if ebay could show that info I doubt that they would.
But that wasn't your issue in this situation anyway.
I don't see a really good outcome for you in this case because the buyer is not obligated to provide pictures to show what the problem with the item was. I don't have all of the info but it's possible that once you asked for the picture the buyer decided to just let the matter go and not bother doing the return. If it was left alone, the case would have eventually timed out. It sounds as if you asked ebay to step in and in the majority of not as described cases, a bot will automatically close the case in the buyer's favour. They may ask the buyer to return the item for a refund. Or, they may just force you to refund since you haven't actually accepted the return request. In a situation like that you would end up with a defect for a case closed without seller resolution.
The best thing to do in a return request is to tell the buyer to return the item. You get the item back and can resell it. You do end up being out shipping costs but it's impossible to get away from a situation like that happening once in a while.
If you phone ebay and talk to them so that it is a person and not a bot deciding the case, it's possible that the cs rep will decide that the buyer didn't want to really return the item and will close the case in your favour. But that is a long shot.
eBay does not want to get into a he said/she said situation so they err on the side of caution and assume that the item was not as described. I'm not going to get into what is fair and what isn't...just stating how things tend to work here most of the time. But once in a while things don't happen the way that we expect them to so there may be hope. Good luck!

I couldn't quite follow along as your report of events seems jumbled to me.
For international sales eBay has been deciding cases and then putting them on hold to give sellers time to deal with return shipping.
Perhaps that's what your hold is all about? Not sure.

eBay said they'd give me a decision in 48 Hrs. This did not happen.
I waited another 24 hrs. after the deadline and phoned.
They closed the case in my favour immediately.
However the case page just continually said they were waiting on buyer, and case was on hold when at first they claimed decision in 48 hrs.
So basically if I didn't phone this would have went on indefinitely.
Seller held hostage for a month, and poor info from eBay on procedures and Sellers abilities and options to counter claim false info from disgraceful dishonest buyers.

You cannot always trust what CS says over the phone. The sometimes will just say anything that sounds good to the seller.
