Ive contacted the seller, but I have yet to get a reply.
I cant seem to get in contact (electronically) with ebay to clarify what happend.
what is my next course of action?

Hi,,,
You need to open a INR (Item Not Received) dispute with PP (PayPal) in the "Resolution Center in your ebay summary page, enter in the item has been removed by ebay and escalate claim.
DO NOT...I REPEAT... DO NOT CLOSE until you get the money or the item.
If you receive the item at a later time, you can always repay the seller.

No communication from the seller is always a bad sign. You did give the seller time to get back to you, yes? Sometimes listings get pulled for those VERO copyright violations, yet it is a perfectly legit item and the seller has it in the mail. Other times you never hear from her again and the seller ends up 'No longer a registered user', - another bad sign.
