I have purchased an item that is pre-order and have not received it yet because it is not available yet. However eBay is asking me if there is a problem because I have until January 13 to resolve a problem if there should be one. I will not know before February if there will be a problem or not. By buying and paying pre-order do I lose the right to any claim or help whatsoever from eBay? Does that mean I will not be able to post any feedback when I receive the item? Does that mean then that the seller is free not to send the item I paid for and that I will not be able to do anything about it?

A seller is not supposed to list anything that they can not ship within 30 days so that listing wasn't ebay 'legal' You have to decide whether you want to take a chance that they will ship the item to you once it is available or file for an item not received so that you can take advantage of buyer protection. Or...the seller may be willing to work with you by cancelling the sale and refunding your money and then relisting it so that you can buy it again with a new start date.

Yes.
There are specific deadlines to make a claim for non-receipt. Every day we see buyers coming on these boards asking for help because they waited too long to file a claim. If you are unsure about the deadline to file a claim, I suggest you contact "Customer Support" - link on top of the page at right.

Tell the seller you have changed your mind and ask for a Mutual Cancellation.
If he will not give you one, file an Item Not Received claim.
I am being harsh because the seller listed illegally (knowingly or not) and you are feeling nervous.
The deal is not good enough for the tension. Have you priced ulcer meds lately?
