Purchased a phone and received it today. IMEI is blacklisted even though the add specifically said it was clean. Paypal dispute? Police?

I see nothing in the listing that could indicate a dodgy item, but as you say it does not work

then yes, you will want to file an Item 'Not as Described' claim.  You've already seen this

link about what to do when an item does not match the description:

Your second post implies that you have already opened the claim.   Good.

The next thing to do is return it, safely packaged, in the same condition it arrived, using

a Delivery Confirmed service, like Xpresspost.

If you send it back cheap-o post the seller can say it never arrived and there will be nothing

you can do about it.

 

When the seller gets the item back, he uses the Refund link in his paypal account and refunds

you the total you paid, - both item price and shipping.

If he does not refund the shipping voluntarily, paypal will do it and get their $$ back from him.

Oh, I meant to add, - whether or not to pay your return shipping is up to the seller.

If the item is truly defective he may indeed do so, although dangling police at him is

not likely to elicit his fullest co-operation.

Otherwise he can add it in to the total when he refunds, or use the Send Money link

from his paypal account to yours.

 

Again, to refund the buyer's return shipping charges is never forced.  The theory being

I suppose that in the event of a problem, each of you is out one shipping fee.

Thanks for the reply. Yes, he has volunteered to pay return shipping, so I will get it to him confirmed and insured. I didn't dangle the police at him directly but did file the complaint as "Possibly stolen goods." It was immediately escalated by the seller to a claim and he has sent a request to cancel the transaction which I will accept once I have been refunded in full. I think it was all just a mixup in his part for not checking the IMEI when he bought it. Luckily for me PayPal is there to protect me.

This is the second phone in a week that has burned me on eBay so I think I'll just pick up a new one tomorrow from the local store.

Insurance covers damage and loss in transit. With good packaging there should not be a problem.

Buying insurance is buying peace of mind, but has no Real World use.

Update:

 

Item was returned yesterday (delivery confirmed by CPC), seller refunded return postage, transaction is in dispute but original purchase has not yet been refunded. I guess I wait.
