Selling Nightvision

Honestly, this is just silly.

I have an Armasight NYX14 Gen 2+ nightvision monocle, that was purchased IN Canada from a company in Alberta called Scout Basecamp.  The monocle was imported into Canada legally.  This specific one is manufactered for international sale to US, Canada, and Europe.
The companies website (which I'm not posting because I don't want to get into trouble for external links) even specifically says;

--------------------------------

This product can be exported to Canada and Europe

The model is specifically produced for international sale. As a result it may have an extra 24 hours lead time and will ship directly from the manufacturer. Some US designated countries and groups may still not be eligible:

  • Denied Persons list
  • Entity List
  • Specially Designated Nationals List
  • Debarred Parties List
  • Nonproliferation Sanctions List
  • Embargoed Countries and Destinations (see EAR part 746) and OFAC Sanctions Programs

--------------------------------

Now.  I just spent 40 minutes on hold.  So, I'm not going to be calling eBay back, that is absolutely silly.  I just want to be able to post my item.  The selling page error prompt even says "Please ensure that your listing does not contravene the above guidelines or your buying and selling privileges could be restricted." Well ok... I did ensure my listing does not contravene the above guidelines, why can't I post it?

What is the solution here?  I'm hoping it doesn't involve 3 hours on hold.
Fun fact; it also won't let me list it for only sale in Canada....

Thanks.

"What is the solution here?"

Find another venue to sell your item.  eBay has many rules and policies that often do not make much sense but they own the site and make the rules.

Re: Selling Nightvision

Your answer is in your question.

Some US designated countries and groups may still not be eligible:

  • Denied Persons list
  • Entity List
  • Specially Designated Nationals List
  • Debarred Parties List
  • Nonproliferation Sanctions List
  • Embargoed Countries and Destinations (see EAR part 746) and OFAC Sanctions Programs

EBay also refuses listing to legal, but restricted, l products like tobacco and alcohol. EBay is a world wide site and cannot control who buys offered items.

Re: Selling Nightvision

That would appear to make sense, however theyre also restricted selling it in Canada, which is its own country of origin.

Further more makes no sense considering this;
http://www.ebay.ca/itm/Night-Vision-Mini-Monocular-D128-Gen2-/280888166120?hash=item41663d46e8:m:mml...

This item has very similar qualities, located in Ontario, Canada,, and the same performance as far as device standards go with gen2+ optics.  So I find it rather odd that this individual can sell that on ebay and has it listed for selling worldwide, but I can't sell one worldwide or in country of origin.

Re: Selling Nightvision

eBay is a U.S. company so I think that both .com an .ca have the same restrictions.  If that other item is similar it is odd that someone not in the U.S. can sell it since that is a requirement according to the rules below.  (see bolded part)

But if I were you, I wouldn't bother phoning ebay about it because even if customer service tells you to go ahead and list it in Canada, chances are good that a bot will take the listing down and that could cause you some problems.

Prohibited and restricted items.

Restricted

The import and export of many military items and information is strictly regulated by US federal law and regulations. Before listing any military items on eBay, check the list in the International Traffic in Arms Regulations (ITAR) Part 121 to see if your item is covered by Part 121.

Some military items (such as body armour, firearm scopes, head gear, and night vision goggles) listed in the ITAR Part 121 are OK to sell, but only if all of the following conditions are met:

  • The item is listed on the US eBay website (eBay.com).

  • The buyer, the seller, and the item are located in the US

  • The seller specifically states the item will only be shipped domestically (within the US).

Note: You must be a US citizen or permanent resident of the US to bid on or buy these types of items. These items can only be bid on or bought if the buyer intends to use the item for personal use only and has no intention of exporting the item outside of the US.

You can list these items under certain conditions:
