Hi! I was scammed by seller. I can't report since it's more than 45 days. What to do??

Hey guys

Usually i have no problem with ebay and this is the 1st time so please help me.

I ordered and paid for a dress on 21 October 2013. I am in Canada so it takes 1 month before I received it. When i got the dress, I realised that I got the wrong dress and the wrong size so I took pictures and contacted the seller who promised to send the right one. It was on the 21 December and I figured since he or she promised, I will just wait. I did not know that I had to report to eBay within 45 days because for me 1 month from the time the wrong item was shipped and another 1 month for the right item to come, it would be OK. I waited after the holidays to contact the seller again and he/she said they did ship it and when I asked to which address they shipped it or what is the confirmation number of the number, they never got back to me. So now I can't get any refund nor complain to eBay nor get the right dress nor use the wrong one they set me since it was not even my size!!!

Please help!! I don't know what to do!!!

Today's lesson. Never accept a replacement. They take too long and there is no reason to believe the replacement will be any better than the original.

I notice that the seller did not ask you to return the incorrect dress. That's good, since it would cost a small fortune ($40 or more). The seller was apparently satisfied with the pictures.

However.

Forget eBay and PP, they cannot help you at this point. They are very firm about the 45 day deadline.

Instead, go to the credit card you used to pay with. (The payment was processed by Paypal so that the seller never sees your cc information.) Call the 1-800 number and give the Customer Service clerk the date, payment including postage, transaction numbers, everything she needs to make your refund.

You have up to 60 days from purchase to leave feedback. The most effective feedback is calm and factual.

At that time you will be asked to give Detailed Seller Ratings. The normal Rating is five stars . The lowest Rating is ONE STAR. No stars is a free pass.

If a seller's DSRs drop below 4.3 her account is restricted and she finds in difficult or impossible to list and sell on eBay.

Might I also recommend that you notify the seller that you will be taking the course of action that femmefan recommends, and see if that triggers resolution. The best and easiest resolve here would be if the seller comes through for you, and notifying them this way could be the proverbial fire under the butt.

As femmefan says, keep it calm and rational, one way or another you will get your money back. Just tell the seller that since you have not heard from them you must assume that they are not interested in resolving the problem and so you will be contacting your credit card company to pursue a chargeback.

You can always drop the chargeback claim at a later time if the seller makes amends.

Don't worry, you have the high ground here.

Re: Today's lesson. Never accept a replacement. They take too...

I am in the same boat as you except that they did not send anything at all. So after a first month and nothing, they said they would resend.  Then said they would pay me back and resend.  I am now to late for anything, and don't understand that ebay and paypal can allow such a short resolution time, and even worst, such a short feedback time when almost all transactions involve international shipping.  Now I just found out that sellers ratings are worth nothing  😞

Re: Today's lesson. Never accept a replacement. They take too...

crikets777,

45 days is ample time to resolve issues, including international one. If you file your claim within that time, the seller would have to prove the item was delivered. If they can't, you get your money back. 60 days is enough time to leave feedback.

" almost all transactions involve international shipping"

That is only true if you choose to buy from sellers in other countries. That is not true in general.

Although some sellers will try to stall a buyer past the deadlines, it is up to the buyer to know the protections available to them from ebay and paypal. Now that you know there are deadlines, make sure you pay close attention to when a sale ended. If you have not received your item in about 3 weeks, you should notify the seller. If you still haven't received it by day 30, start the item not received process. For international transactions, you might want to wait untili day 40 to file a dispute. Although that is close to the 45 day deadline, you are still protected because all you need to do is file dispute within the 45 days, not resolve it so it is possible the resolution may go beyond the deadline but as long as you have filed within the time period, you are still 100% protected.

Non payers should get unpaid item strikes and be added to block bidders lists. Period.

I have the same problem too and I didn't know about the 45 days period and I feel terrible. I wish ebay could do something about these complaints. My case actually happened around the same time, starting from end of Sep2013 and this seller dragged me on until the beginning of this year and disappeared. I never received anything and he kept saying he had sent me the shoes twice! He even promised a refund!

That seller is in China and if he sends his parcels by surface mail, it can take more than 6 weeks to arrive to Canada. Are we allowed to mention the seller's ID so other buyers know not to buy from him or her?
