I had a case open for non-payment

This buyer did not pay nor did he/she respond to my messages.  I have received my ebay fee credit on this transaction.  My understanding is that a non-payment notice would be placed on the account by Ebay.  However the account still has 2 positive feedbacks with no negative.  How can I leave negative feedback on this account for non payment?

Update regarding the lost Brazil package that was mailed before Nov 5 but refunded after the Nov 5 (USA) Dec 16th (Can) dates. This one has not received a defect. which is good, so the date timing is the timing of the case, not when the item was sold.....

Yes, when I asked about it, the announcement was on the U.S. announcement board only.  After that, it was put on the Canadian board announcement so it made sense to me that the announcement was for Canadians as well. That was confirmed today on the weekly board hour.
